These Terms of Use (“Terms”) govern your use of the Pocket Song mobile apps (iOS and Android) and website at pocketsong.app. By downloading or using Pocket Song, you agree to these Terms.

1. The service

Pocket Song lets you create original AI-assisted songs from structured choices (such as mood, genre, language, and voice). Features may change as we improve the product.

2. Eligibility

You must be able to enter a binding agreement under applicable law and meet the age requirements of the store where you download the app (Apple App Store or Google Play) in your region.

3. Accounts & device use

The MVP may operate primarily on-device with server-side limits tied to device identifiers and purchase status. You are responsible for activity on your device related to the app.

4. Subscriptions & payments

• Optional Premium subscriptions are sold through the Apple App Store or Google Play, depending on your platform.
• Prices, billing periods, and free tiers are shown in-app and/or on the store product page.
• Billing, renewals, refunds, and cancellations are handled by Apple or Google under their respective terms.
• Manage subscriptions in your platform’s subscription settings (iOS Settings → Apple ID → Subscriptions, or Google Play → Payments & subscriptions).

5. License to generated content

Pocket Song creates a new song or melody for you from the choices you make in the app. Outputs are generated on demand for your request — they are not copies of an existing commercial track from a catalog.

Subject to these Terms and applicable law, you may use songs you generate with Pocket Song for personal and ordinary social sharing. You are responsible for how you use outputs (including compliance with platform rules where you publish).

You must not use Pocket Song to infringe others’ rights, impersonate artists, or generate unlawful, hateful, or abusive content.

6. Acceptable use

You agree not to:

• Abuse, overload, or reverse engineer the service or API beyond normal app use
• Bypass paywalls, quotas, or security controls
• Attempt to extract secrets, tokens, or upstream provider credentials
• Use automated systems to mass-generate content in a way that harms the service

7. Intellectual property

The Pocket Song name, branding, app UI, and website materials are owned by us or our licensors. Upstream AI providers and Apple retain their respective rights.

8. Disclaimer

Pocket Song is provided “as is” and “as available”. Generation quality, availability, and processing times can vary. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Pocket Song and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the app.

10. Termination

We may suspend or limit access if you violate these Terms or abuse the service. You may stop using the app at any time and uninstall it.

11. Privacy

Our Privacy Policy explains how we handle information.

12. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes means you accept the updated Terms.
